The Brazilian Court of Appeal has reaffirmed in a court ruling the validity of NYSE-listed Brazil Potash Corporation's Autezes project's environmental licenses and the legality of the Mura indigenous consultation process.

The project has faced challenges from federal prosecutors and indigenous groups over ancestral land use, however, the company says the latest ruling marks an advance in establishing the legal status of the Autazes project. 

Brazil Potash aims to have the project produce 2.4-million tons of potash every year to supply the domestic agriculture sector and reduce Brazil's heavy reliance on imported fertiliser.

"These rulings reinforce the strong legal foundation on which we are advancing the Autazes project. We remain fully committed to the responsible development of the project and continue to engage collaboratively with stakeholders as we advance toward construction," says Brazil Potash subsidiary Potássio do Brasil president Sergio Leite.

In conducting the admissibility review of special and extraordinary appeals filed by the Federal Public Prosecutor's Office, the Mura Indigenous Leadership Organization of Careiro da Várzea, and the Lago do Soares Indigenous Community, the Vice-President of the Brazilian Court of Appeal concluded that the appeals do not meet the legal requirements for processing before the Superior Court of Justice and the Federal Supreme Court, thereby ruling them inadmissible for court procedures at higher levels.

The latest court ruling affirms the validity of the consultation process conducted with the Mura Indigenous people, the authority of the Amazonas Environmental Protection Institute to conduct the Autezes project's environmental licencing and the validity of the environmental licences having been issued for the project already - thereby confirming an earlier ruling made by a regional court. 

Interlocutory appeals against the inadmissibility decisions are still available to the parties and Brazil Potash can not say with certainty whether any further procedural measures will be pursued or what their outcome will be.

Brazil Potash emphasises that Brazil is critical for global food security as the country has among the highest amounts of fresh water, arable land and ideal climate for year-round crop growth, but it remains vulnerable as it imported about 97% of its potash fertiliser requirement in 2025, despite having what is anticipated to be one of the world's largest undeveloped potash basins.

The Autezes project is expected to produce about 20% of Brazil's current potash demand once in production.
