Municipal Finance Management Act

The Municipal Finance Management Act is South African legislation that regulates financial management in local government. Enacted in 2003 as Act 56 of 2003, it establishes a framework for managing municipal finances, including budgeting, accounting, reporting and auditing requirements. The Act aims to secure sound and sustainable management of the fiscal and financial affairs of municipalities and municipal entities. It sets out the duties and responsibilities of mayors, councillors, municipal managers and chief financial officers in relation to financial governance. The legislation requires municipalities to adopt annual budgets, maintain effective systems of financial management and internal control, and prepare annual financial statements. It also establishes mechanisms for national and provincial oversight of municipal finances. The Act empowers the National Treasury to monitor municipal compliance and intervene when municipalities fail to meet their financial obligations. Enforcement provisions include consequences for financial misconduct by municipal officials. The Municipal Finance Management Act works in conjunction with the Municipal Systems Act and the Public Finance Management Act to create a comprehensive framework for public-sector financial governance in South Africa. It has become a key instrument in efforts to address municipal financial mismanagement and improve service delivery at local government level.
