The Constitutional Court’s scathing judgment when upholding a North Gauteng High Court ruling that Public Protector Busisiwe Mkhwebane pay 15% of the South African Reserve Bank’s legal fees in the Absa/Bankorp review case said it all. Mkhwebane was found to have acted in bad faith and dishonestly. She also failed to engage with the parties directly affected by her remedial action before she published her final report and did not produce transcriptions of her meetings with The Presidency and the State Security Agency. The Public Protector’s various explanations for her conduct were also found to be contradictory.
