WILD COAST'S WILD CARD:

14th December 2018

The mining industry has been dealt a wild card by the Wild Coast, where the community has said no to the mining of titanium. It is the community of Umgungundlovu, a portion of Xolobeni, and it has been given the right to say no by the High Court in Pretoria. The full consent of informal land right holders must be obtained before the Mineral Resources Minister may grant a mining right, the court decreed. Informal rights, as contemplated in the Interim Protection of Informal Rights to Land Act 31 of 1996, are trumping formal rights. Wild cards are trumping mild cards that have the capacity to ensure a win-win for all South Africans. What needs to be widely communicated is that mining can take place while the area is simultaneously rehabilitated and restored.
