India to set up mining regulatory authority under new legislation
KOLKATA (miningweekly.com) - India was planning to set up a National Mining Regulatory Authority (NMRA) under new mines and mineral development legislation, the Mines Ministry said this week.
The NMRA would be created under auspices of the Mines and Minerals (Development & Regulation) Bill 2011, which was currently before Parliament for approval, the Ministry said.
The regulatory authority would have the mandate to conduct investigations and prosecute in cases of illegal mining of major minerals.
However, the Mines Ministry issued no clarification over the role of the Indian Bureau of Mines vis-à-vis the new regulatory authority or the division of responsibilities between the two regulatory bodies.
A similar regulatory authority, exclusively for the coal sector, had been hanging fire for over a year with disagreements within the government on whether to accord the coal regulator the authority to allocate coal blocks and determine pricing issues.
A Group of Ministers meeting held earlier this month to expedite the establishment of the coal regulator remained inconclusive.
