JOHANNESBURG (miningweekly.com) – Fluorspar-miner Sallies has requested the Federal Supreme Court of Switzerland to review the International Chamber of Commerce Arbitral Tribunal’s $1 243 824 finding against it, in the case brought by Honeywell International.
Sallies has also requested the Swiss federal court to instruct the tribunal to reject Honeywell’s claim and to approve Sallies counterclaim.
The tribunal also dismissed Sallies $3 095 119 counterclaim and awarded interest at 5 % a year from January 19, 2006, until the full $1 243 824 payment was made.
The amount Honeywell had originally claimed was $6 847 305 plus interest and costs, and its alternative claim was for $4 514 457 plus interest and costs, but the tribunal ruled that each party paid its own costs.
Sallies said that the interest on the amount payable to Honeywell in the final award would amount to $209 000 by May 31 and requested the Swiss federal court to set aside the tribunal’s final award, which would result in the case being sent back to the tribunal for reassessment.
