Recent court judgments have placed occupiers of land in the driving seat of mining decision-making. Dictating the way forward are the Constitutional Court’s overturning of the eviction of 37 members of the Lesetlheng community of the North West province; the Pretoria High Court’s siding with 128 members of the Amadiba community living in Xolobeni, on the Wild Coast of South Africa’s Eastern Cape; and the Kimberley High Court’s judgment on the eviction of Dingleton community members, in the Northern Cape. Against the background of these judgments, Mineral Resources Minister Gwede Mantashe is going all out to show how mining can be a win-win for all South Africans.
