South African Human Rights Commission

The South African Human Rights Commission is an independent statutory body established to support constitutional democracy by promoting and protecting human rights in South Africa. The commission was created under Chapter 9 of the Constitution of the Republic of South Africa, 1996, and derives its mandate from the South African Human Rights Commission Act 40 of 1994. It operates independently of government and is accountable only to the National Assembly. The commission's core functions include investigating human rights violations, monitoring and assessing the observance of human rights in the country, conducting research and education on human rights matters, and recommending measures to organs of state to promote respect for human rights. It has the power to subpoena witnesses, gather evidence and enter premises to investigate complaints. The commission addresses a wide range of rights enshrined in the Bill of Rights, including equality, dignity, access to basic services, housing, healthcare and environmental rights. It plays a significant role in holding government and private entities accountable for failures in service delivery and discrimination. The commission is headed by a chairperson and comprises commissioners appointed by the President on the recommendation of the National Assembly. It maintains offices in all nine provinces and regularly appears in media coverage related to systemic rights violations, particularly concerning water provision, sanitation, housing and access to essential services.
