Western Coal says aware of potential lawsuit

TORONTO (miningweekly.com) – Vancouver-based Western Coal Corp is aware of a potential class action lawsuit against the company, it said on Tuesday.

Western has received service of the proposed suit, which was launched in the Ontario Superior Court of Justice on November 20.

The lawsuit alleges inaccurate disclosure in Western's fiscal second quarter 2007 report, the coal-miner said in a statement.

“The company believes these allegations are without merit and intends to vigorously defend them as well as the plaintiff's attempt to obtain court approval to proceed with the action.”

Western Coal, which acquired Cambrian Mining earlier this year, has coal operations in Western Canada and West Virginia, in the US.

Shares in the company slid 1,82% in early trade on Tuesday, to C$2,70 apiece by 9:45 in Toronto.
