LABOUR LAW COURSE
The Professional Development Project of the Faculty of Law, in partnership with the Institute of Labour Law and Development, UCT, is pleased to present a five–day course in Labour Law on 18 to 22 May 2015.

ABOUT THE COURSE
Tension in the labour market, more than at any time since 1994, is a prominent feature in the daily news. An important question is whether current labour laws are sufficient to address the challenges faced by an emerging market. The course will contextualise these laws and provide students with a basic understanding of the most significant labour laws and their impact on the daily operations of businesses.

This course will give delegates a good understanding of labour law in South Africa.

WHO WILL BENEFIT FROM THIS COURSE?
Anyone involved in human resources - HR directors, HR managers and HR staff – as well as company law advisors and managers who may be called upon to deal with any employment law issues.

COURSE OUTLINE

THE COURSE WILL COVER THE FOLLOWING TOPICS:

Introduction to employment law
- History of employment law in SA – focusing on the changes since 1995
- Understanding the foundations of employment law in SA – common law
- Overview of labour legislation
- Basic Conditions of Employment – Labour Relations Act – Employment Equity Act – Occupational Health and Safety Act –
- Compensation for Occupational Injuries and Diseases Act
- Determining who is an employee

- The Department of Labour
- Bargaining Councils
- The CCMA
- The Labour Court

Drafting contracts of employment and setting up basic policies
- Understanding terms and conditions of employment regarding management prerogative and statutory requirements
- Drafting the contract of employment – permanent or fixed term

- Collective agreements, bargaining council agreements

Dismissal and unfair labour practices
- The meaning of dismissal and unfair labour practices

COURSE PRESENTERS
The course will be facilitated by Professor Rochelle Le Roux, currently a professor in the Faculty of Law. In January 2012 she became the director of the Institute of Development and Labour Law. She has a PhD from UCT and her main research interest is the scope of employment. She regularly publishes in peer-reviewed/accredited journals and in 2005 published a book Sexual Harassment in the Workplace: Law, Policies and Processes with Thandi Orleyn and Alan Rycroft. A further edition of this book, Harassment in the Workplace: Law, Policies and Processes, was published in August 2010.

Rochelle is a non-executive director of the South African Reserve Bank and also a member of the board of the South African Institute for Drug-Free Sport.

Other presenters are well-known academics and practitioners specialising in the field of labour law.

REGISTRATION DETAILS
Programme and venue information:
Signing in will commence at 9:00 unless otherwise advised. Each day will end at approximately 17:00. Instructions regarding the programme and directions to the venue will be sent to you electronically a week prior to the event.
         
Award of certificate:
A certificate of attendance will be awarded to everyone attending the full five days of lectures. Please ensure that you sign the attendance register every day.

Course fee:  
R10,000 per delegate. The fee includes parking, teas, lunches and any course materials.
