Another court win for Lynas
PERTH (miningweekly.com) - The Kuantan High Court, in Malaysia, has again thrown its backing behind rare earths miner Lynas, by denying an application from the Save Malaysia Stop Lynas group for leave to seek a judicial review on the award of a temporary operating licence (TOL) for the advanced materials plant (Lamp).
During December last year, the Malaysian Court of Appeals dismissed a court challenge by environmental group Save Malaysia Stop Lynas, against the grant of a TOL for the Lamp, with the environmental group subsequently turning to the Kuantan High Court.
Both Lynas and the Malaysian government have consistently defended the process undertaken by the Atomic Energy Licensing Board and the Malaysian government in granting the TOL.
Despite the overhanging court threats, Lynas has continued with the commissioning of the Lamp, with the project nearing commercial rare earths production.
Lynas said this week that following the Kuantan High Court decision, there remained no injunction or stay preventing the company from continuing to carry out its operations at Lamp.
